Your privacy is valued and respected at Passport Booth (“we” or “our” or “us”). This Privacy Policy (“Privacy Policy”) describes the types of information, including Personal Information, that we gather from you when you use our websites (including PassportBooth.com), apps, services and/or online stores (the “Service”), as well as your choices regarding use and disclosure of your Personal Information. As used in this Privacy Policy, the term “Personal Information” means information that identifies you personally, alone or in combination with other information available to us.

By accessing the Service, you agree to be bound by this Privacy Policy. If you do not agree to the terms of this Privacy Policy, please do not use our Service. Each time you use our Service, the current version of the Privacy Policy will apply. B. Information Collected by Passport Booth


When you use our Service, Passport Booth collects information (i) that you knowingly and voluntarily provide when you use our Service (such as through forms or profile screens) including registration/account setup information, and (ii) that we are able to collect from your web browser, cookies and other similar technologies. We may also aggregate information across our Service and with third party information to create a profile of you.

1. Information that you Knowingly and Willingly Provide

Passport Booth collects the information that you knowingly and voluntarily provide when you use our Service (such as through web forms or profile screens), including registration/account setup information, profile details, payment information, and ratings information. We primarily use this information to fulfill your transaction requests. You can choose not to provide us with certain Personal Information, but then you may not be able to take advantage of the Service or other available features we offer. The information that we collect and use may include the following kinds of Personal Information:

  • First and Last Name
  • Email Address
  • Postal Address 
  • Credit and/or Debit Card Information
  • Images of your face


2. Non-Personal Information

Passport Booth collects information that is sent to us automatically by your web browser. Passport Booth may use this information to generate aggregate statistics about visitors to the Service. This information typically includes details about your:

  • Device Type (e.g. desktop, laptop, tablet, phone, etc.)
  • Screen Size, Color, Depth, and System Fonts
  • IP Address
  • Browser Type
  • Browser Plug-In Details
  • Operating System 
  • Local Time Zone
  • Date and Time of Each Visitor Request (e.g. web pages selected and time spent on each page)
  • Referring Site and/or Search Engine

Passport Booth may use non-Personal Information for various business purposes such as providing customer service, fraud prevention, market research, and improving our Service.

The information we receive depends on the settings on your browser. Please check your browser if you want to learn what information your browser sends or how to change your settings.

Aggregate Information. We may aggregate and/or anonymize all information that we collect from you, including Personal Information, for the purpose of market research on brands and products, marketing campaigns, and advertising.

3. Information Collected by Cookies, Web Beacons and Other Technologies.

Passport Booth may obtain information about you by installing "cookies" on your mobile device and/or computer's hard drive. We use cookies to collect statistical information about the ways visitors use our Service including which pages they visit, which links they use, and how long they stay on each page. Passport Booth also may use cookies to create a database of your previous choices and preferences, saving you time and effort. If you do not wish to receive cookies, you may set your browser to reject cookies or to alert you when a cookie is placed on your computer. If you limit or disable the use of cookies when you visit Passport Booth, you may be unable to use the full of the functionality of our Service.

Pixel Tags. These enable us to send email messages in a format customers can read, and they tell us whether mail has been opened. We may use this information to reduce or eliminate messages sent to customers.

Third Parties. Advertisers and third parties also may collect information about your activity on our Service and on third-party sites and applications using tracking technologies. Tracking data collected by these advertisers and third parties can be used to decide which ads you see on our Service, and on third-party sites and applications, but does not identify you personally and is not associated with your registration account.

C. How Is Your Personal Information Used?


We may use online Personal Information that we collect about you on its own or combine it with other information we have about you to:

  • To create user accounts and/or profiles through registration;
  • Provide product and/or service fulfillment, such as creating passport photos, user accounts, managing purchases, payments, quality control, and more;
  • Perform internal operations, such as tracking and improving the effectiveness of our website, mobile experience, and marketing efforts;
  • Personalize user experiences, such as remembering your settings and preferences;
  • Provide support;
  • Advertise and market our products and services;
  • Provide information to our representatives and/or advisors, such as our attorneys, accountants, and others to help us comply with legal, accounting, or security requirements;
  • Protect the rights, safety, and information of our members, third parties, as well as our own. This includes fraud prevention, business or product recalls, prosecuting and defending a court arbitration or similar proceeding, and more; or

D. Who Can Access the Information We Collect?


Passport Booth may disclose your Personal Information in the following instances:

Agents. We employ other companies and individuals to perform functions on our behalf. Examples of such functions include fulfilling orders, delivering packages, sending postal mail and e-mail, removing repetitive information from customer lists, analyzing data, providing technical support, providing marketing assistance, providing search results and links (including paid listings and links), processing credit card payments, and providing customer service. We share our users’ Personal Information with these agents as we deem necessary for such third parties to perform their functions.

Employees. Only authorized employees have access to your Personal Information.

Affiliates and Subsidiaries. Passport Booth may share Personal Information with our corporate subsidiaries and affiliates for uses consistent with this Privacy Policy.

To comply with legal process, protect Passport Booth, or enforce our rights. We may release your Personal Information when it is necessary to (a) conform to legal requirements or comply with legal process; (b) enforce or apply our conditions of use and other agreements (c) protect the rights, safety or property of Passport Booth, our affiliates, service providers, our users or the public, or (d) prevent a crime or protect national security (including exchanging information with other companies and organizations for fraud protection and credit risk reduction).

As part of a merger or sale of business. We may disclose your Personal Information in connection with a substantial corporate transaction, such as the sale of our business, a divestiture, merger, consolidation, or asset sale, or in the unlikely event of bankruptcy.

E. Selling of Personal Information
We will not sell your Personal Information to third parties for their use without your consent.

F. Children and Privacy
Our Services are not directed to persons under 13. If you become aware that your child has provided us with personal information without your consent, please contact us. We do not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided us with personal information, we take steps to remove such information and terminate the child’s account. 

G. Third Party Service Providers

Our Service may contain links to third party websites, applications and services not operated by us. These links are provided as a service and do not imply any endorsement by Passport Booth of the activities or content of these sites, applications or services nor any association with their operators. Passport Booth is not responsible for the privacy policies or practices of any third party including websites or services directly linked to our Service. We encourage you to review the privacy policies of any third party site that you link from our Service.

H. Security, Storage, & Retention


1. Security
We take reasonable technical and organizational precautions to protect the confidentiality, security and integrity of your Personal Information. Although we use security measures to help protect your Personal Information against loss, misuse or unauthorized disclosure, we cannot guarantee the security of information transmitted to us over the Internet. While we strive to use commercially acceptable means to protect your Personal Information, there is no guarantee that information may not be accessed, disclosed, altered or destroyed.

2. Storage
The Personal Information that you provide to us is generally stored on servers located in the United States. If you are located in another jurisdiction, you should be aware that once your Personal Information is submitted through our Service, it will be transferred to our servers in the United States and that the United States currently does not have uniform data protection laws in place.

3. Retention
We will retain your information for as long as your account is active or as needed to provide you with our Service. If you wish to cancel your account or request that we no longer use your information to provide you service, contact us at support@passportbooth.com. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

I. International Users


We are headquartered in the United States of America. Your Personal Information may be accessed by us or transferred to us in the United States or to our affiliates, partners, merchants, or service providers who are located worldwide. If you are visiting our Service from outside the United States, be aware that your information may be transferred to, stored, and processed in the United States where our servers are located and our central database is operated. By using our Services, you consent to this transfer. We will protect the privacy and security of Personal Information according to this Privacy Policy, regardless of where it is processed or stored, however you explicitly acknowledge and consent to the fact that Personal Information stored or processed in the United States will be subject to the laws of the United States, including the ability of governments, courts or law enforcement or regulatory agencies of the United States to obtain disclosure of your Personal Information.

J. Changes to this Privacy Policy
We reserve the right to update or modify this Privacy Policy from time to time. If we make any material changes to this Privacy Policy or the way we use, share or collect Personal Information, we will notify you by revising the “Effective Date” date at the top of this Privacy Policy, prominently posting an announcement of the changes on our Service, or sending you an email to the email address you most recently provided us in your account, profile or registration (unless we do not have such an email address) prior to the new policy taking effect. Users are bound by any changes to the Privacy Policy when he or she uses the Service after notice of such changes has been communicated. We encourage you to review this Privacy Policy regularly to ensure that you are familiar with Passport Booth’s current practices.

K. Information Correction, Removal, and Opting-Out

If any of the information that we have about you is incorrect, or you wish to have information (including Personal Information) removed from our records, please contact us at support@passportbooth.com. We will respond to such inquiries within fifteen (15) business days. 

2. Opting Out
Additionally, if you prefer not to receive marketing messages from us, please let us know by clicking on the unsubscribe link within any marketing message that you receive, or by sending a message to us at support@passportbooth.com.

3. Your California Rights
FOR RESIDENTS OF CALIFORNIA ONLY. Section 1798.83 of the California Civil Code requires select businesses to disclose policies relating to the sharing of certain categories of your Personal Information with third parties. If you reside in California and have provided your Personal Information to Company, you may request information about our disclosures of certain categories of Personal Information to third parties for direct marketing purposes. Such requests must be submitted to us at the following address: support@passportbooth.com.


Within thirty (30) days of receiving such a request, we will provide a list of the categories of Personal Information disclosed to third parties for third-party direct marketing purposes during the immediately preceding calendar year, along with the names and addresses of those third parties. This request may be made no more than once per calendar year. We reserve our right not to respond to requests submitted other than to the address specified in this Section.

Passport Booth operates a passport printing mobile application (the “Service”). PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING THIS OUR SERVICE.

1. Acceptance of Terms
THESE TERMS OF USE, AS AMENDED FROM TIME TO TIME AND PUBLISHED AT passportbooth.com, AND AS INCORPORATING THE PASSPORT BOOTH PRIVACY POLICY AVAILABLE AT passportbooth.com/terms (“TERMS OF USE”), ARE A LEGAL AGREEMENT BETWEEN PASSPORT BOOTH (“PASSPORT BOOTH”) AND YOU (“YOU”).

YOU MUST READ AND AGREE TO THESE TERMS OF USE, INCLUDING THE PRIVACY POLICY, BEFORE USING THE SERVICE CONTROLLED BY PASSPORT BOOTH. BY USING THE SERVICES, YOU AGREE TO THESE TERMS OF USE. IF YOU DO NOT AGREE TO THESE TERMS OF USE, DO NOT USE THE SERVICE.

You are responsible for regularly reviewing the Terms of Use, as the Terms of Use may be modified at any time. All such modifications will be effective immediately upon posting. If You are dissatisfied with any modification to the Terms of Use, Your only remedy is to terminate Your use of the Service, as described in Section 12 (Termination and Survivability) of these Terms of Use. Your continued use of the Service after a change or update has been made to the Terms of Use constitutes Your acceptance of such change or update.

2. Eligibility
YOU MUST BE AT LEAST 18 YEARS OF AGE TO USE THE SERVICE. By using the Service, You represent and warrant that (a) You are 18 years of age or older; (b) all registration information You submit to Passport Booth is truthful and accurate; (c) You will maintain the accuracy of such information; and (d) Your use of the Service does not violate any applicable law or regulation.

3. User Accounts
To use the Service, You may be required to create a user account (“Account”). If You create an Account, You agree to provide Passport Booth current, complete, true and accurate information, and to update this information should it change. Passport Booth may suspend, terminate, modify, or delete Your Account with or without notice to You, at any time for any reason or for no reason, including but not limited to for violation of the Terms of Use. 

Some parts of the Service may require the payment of fees; if You purchase any goods or services that require payment of fees to Passport Booth, You agree to provide Passport Booth (or Passport Booth’s payment agent) with current, complete, true and accurate billing information, such as Your credit card or other payment system number and expiration date. 

If You create an Account, You may be asked to choose a password and a user name. You agree, in the sole discretion of Passport Booth, that Your user name will not: (i) substantially infringe the legal rights of others, including, but not limited to, by comprising or being substantially similar to a trademark or service mark; (ii) be offensive, vulgar, obscene, hateful, or racially, ethnically or otherwise objectionable; (iii) in any way infringe these Terms of Use; (iv) be otherwise inappropriate, regardless of Passport Booth’s ability to disallow such user names; or (v) be a name that is associated with another person, including but not limited to a celebrity or other well-known person or a Passport Booth representative. 

You agree that You will not take any actions for the purpose of circumventing the foregoing restrictions. You understand and agree that Passport Booth reserves the right to change, remove, alter or delete any user name at any time and for any reason in Passport Booth’s sole discretion. 

YOU ARE ENTIRELY RESPONSIBLE FOR MAINTAINING THE CONFIDENTIALITY OF YOUR PASSWORD AND FOR ANY AND ALL ACTIVITIES THAT OCCUR IN ASSOCIATION WITH YOUR ACCOUNT, WHETHER OR NOT AUTHORIZED BY YOU. You agree to notify Passport Booth immediately of any unauthorized use of Your Account or any other breach of security and to provide properly documented evidence as requested by Passport Booth. You may not use anyone else’s Account at any time and You may not allow anyone else to use Your Account at any time. You agree that Passport Booth will not be liable for any loss You may incur as a result of someone else using Your password or Account, either with or without Your knowledge, and You further agree that You will be liable for losses incurred by Passport Booth or another party due to someone else using Your Account or password. 

PASSPORT BOOTH RESERVES THE RIGHT TO TERMINATE OR SUSPEND YOUR ACCOUNT AND/OR ACCESS TO THE SERVICE AT ANY TIME, FOR ANY REASON OR NO REASON, WITH OR WITHOUT NOTICE TO YOU. PASSPORT BOOTH ALSO RESERVES THE RIGHT TO CHANGE OR DISCONTINUE ANY SERVICE OR FEATURE PROVIDED BY PASSPORT BOOTH, INCLUDING, WITHOUT LIMITATION, THE SERVICE, AT ANY TIME AND WITHOUT NOTICE. YOU AGREE THAT PASSPORT BOOTH SHALL NOT BE LIABLE FOR ANY LOSS OR DAMAGE CAUSED, DIRECTLY OR INDIRECTLY, BY ANY SUCH TERMINATION, SUSPENSION, CHANGE OR DISCONTINUANCE. 

In the event that Your Account is terminated, suspended or canceled, no refund will be granted and no other credits will be credited to You or converted to cash or other form of reimbursement, and You will have no further access to Your Account, Content or anything associated with it.

4. Ownership of Content
“Content” shall mean including, without limitation, data, images, drawings, photographs, video, audio, text, and any and all other material and information You see on the Service, whether provided by Passport Booth or by users of the Service. ALL USE OF CONTENT IS PROVIDED “AS IS” AND AT YOUR OWN RISK. 

YOU ACKNOWLEDGE AND AGREE THAT ALL CONTENT IS THE PROPERTY OF PASSPORT BOOTH AND/OR ITS LICENSORS AND THAT YOU HAVE NO INTELLECTUAL PROPERTY RIGHTS OR OTHER RIGHTS IN ANY CONTENT, REGARDLESS OF WHETHER THAT CONTENT WAS PROVIDED BY PASSPORT BOOTH, YOU, OR ANOTHER USER OF THE SERVICE. 

You acknowledge that the Content and Service are protected by copyrights, trademarks, and other proprietary rights owned by Passport Booth and/or its licensors, including rights to the selection, coordination, arrangement and enhancement of such Content, and that these rights are valid and protected in all media existing now or later developed. Except as expressly provided herein, Passport Booth and its licensors do not grant You any express or implied rights, and all right, title and interest that Passport Booth has in the Service, that are not expressly granted by Passport Booth to You are retained by Passport Booth. No Content may be modified, copied, distributed, framed, reproduced, republished, downloaded, scraped, displayed, posted, transmitted or sold in any form or by any means, in whole or in part, without Passport Booth’s prior written permission, except that the foregoing does not apply to Your own posted submission. 

You agree that You may not upload or otherwise transmit on or through the Service Content that is subject to any third-party rights unless any holder of such rights has given express authorization for distribution on the Service. 

You agree that any Content You submit does not create an obligation for Passport Booth to provide You any payment or other remuneration. If and to the extent You are deemed to have retained, under applicable law, any right, title or interest in or to any portion of the Content, You hereby transfer, grant, convey, assign and relinquish exclusively to Passport Booth all of Your right, title and interest in and to the Content, without reservation and without additional consideration, under applicable patent, copyright, trade secret, trademark and other similar laws or rights, in perpetuity, and in the alternative to the extent such assignment is ineffective under applicable law, You hereby grant to Passport Booth, the exclusive, irrevocable, sublicensable, transferable, worldwide, paid-up license to reproduce, fix, adapt, modify, translate, reformat, create derivative works from, manufacture, introduce into circulation, publish, distribute, sell, license, sublicense, transfer, rent, lease, transmit, publicly display, publicly perform, or provide access to electronically, broadcast, communicate to the public by telecommunication, display, perform, enter into computer memory, and use and practice the Content, all modified and derivative works thereof, all portions and copies thereof in any form, all inventions, designs, and marks embodied therein, and all patent, copyright, trade secret, trademark and other intellectual property rights thereto, and/or to incorporate the same in other works in any form, media, or technology now known or later developed. To the extent permitted by applicable laws, You hereby waive any moral rights You may have in the Content.

5. User Limitations
ANY USE OF THE SERVICE IN VIOLATION OF THESE TERMS OF USE WILL BE REGARDED AS AN INFRINGEMENT OF PASSPORT BOOTH’S COPYRIGHT RIGHTS IN AND TO THE CONTENT. 

You may not, under any circumstances, modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, adapt, translate, transfer, buy, auction, rent, lease, loan or sell any Content, or other materials appearing in or generated by the Service, or any information obtained from the Service, without the prior express written consent of Passport Booth. 

You may not, under any circumstances, exploit the Content or the Services for any purpose whatsoever. 

You may not, under any circumstances, use the Content or the Service in any manner that is (i) unlawful; (ii) that could damage, disable, overburden, or impair any Passport Booth server or the network(s) connected to any Passport Booth server; (iii) that could interfere with any other party’s use and enjoyment of the Service; (iv) that gains or attempts to gain unauthorized access to any Service, unpublished information or material, other users’ Accounts, or computer systems and/or networks connected to any Passport Booth server, or to any of the Service, through hacking, password mining or any other means; (v) that collects or aggregates information regarding other users’ actions relating to the Service; or (vi) that reverse engineers, decompiles, disassembles or attempts to reverse engineer, decompile, or disassemble any part of the Content or Service. 

 

6. Passport Booth Copyright Policy
You will refrain from posting any information or items to the Service which are copied, in whole or in part, from third party sources without authorization. For further clarification, please see the U.S. Law on Copyrights, or see the web sites of the U.S. Copyright Office or U.S. Trademark Office. The Digital Millennium Copyright Act of 1998 (the “DMCA”) provides recourse for copyright owners who believe that material appearing on the Internet infringes their rights under U.S. copyright law. If You believe in good faith that materials hosted by Passport Booth infringe Your copyright, You (or Your agent) may send us a notice requesting that the material be removed or access to it blocked. 

Notices and counter-notices with respect to the Service, should be sent to the Passport Booth’s DMCA Agent for notice of claims of copyright infringement by support@passportbooth.com (with the subject line “DMCA Communication”). 

Passport Booth’s DMCA Agent should be contacted only for the purposes set forth in this Section 6. ALL OTHER INQUIRIES DIRECTED TO PASSPORT BOOTH’S DMCA AGENT WILL NOT BE ANSWERED.

7. Rules of Conduct
By way of examples and not as limitations, You agree that You may not access the Service to: 

 

  1. Publish, post, upload, transmit, distribute, disseminate or otherwise make available surveys, contests, pyramid schemes, chain letters, junk email, spamming or any duplicative or unsolicited messages (commercial or otherwise). 
  2. Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights of others, including but not limited to the rights of privacy and publicity. 
  3. Publish, post, upload, transmit, distribute, disseminate or otherwise make available any material that is harmful, abusive, vulgar, sexually explicit, defamatory, libelous, obscene, infringing, embarrassing, unwanted, invasive of another’s right of privacy or publicity, hateful or racially, ethnically or otherwise offensive or objectionable. 
  4. Publish, post, upload, transmit, distribute, disseminate or otherwise make available any material or information, including but not limited to images, photographs, sound files, text files, graphics files, and videos that infringe or misappropriate any copyright, trademark, patent, trade secret, or right of privacy or publicity, or other right of any party. 
  5. Publish, post, upload, transmit, distribute, disseminate or otherwise make available any files that contain viruses, spyware, Trojan horses, worms, time bombs, cancelbots, corrupted data, or any other similar software or programs that may damage or interfere with the operation of the Service, other users’ access to the Service and/or other users’ computers. 
  6. Publish, post, upload, transmit, distribute, disseminate or otherwise make available any material for which copyright management or digital rights management information, such as author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material has been falsified, deleted, or otherwise disabled. 
  7. Violate any applicable laws or regulations, or promote or encourage any illegal activity. 
  8. Publish, post, upload, transmit, distribute, disseminate or otherwise make available any material regarding hacking, cracking, exploiting, or otherwise making use of the Service or the Content in any manner. 
  9. Impersonate or create a false identity, including but not limited to identities falsely indicating that the user is a celebrity or a Passport Booth representative. 
  10. Collect in any manner information regarding users of the Service or other user or usage information or any portion thereof, or distribute such information to any third party. 
  11. Attempt to obtain passwords, other Account information, or any other private information from any other user of the Service, including, without limitation, the collection of personal information of others, including e-mail addresses. 
  12. Make false reports to Passport Booth administrators. 
  13. Publish, post, upload, transmit, distribute, disseminate or otherwise make available any automation software programs or any other unauthorized third-party software program designed to modify the Service. 
  14. Use the Service for fraudulent transactions. 
  15. Frame or mirror any part of the Service without Passport Booth’s express prior written consent. 
  16. Institute an attack upon any server used in connection with the Service or any portion thereof or otherwise attempt to disrupt such servers. 
  17. Modify, adapt, sublicense, translate, sell, reverse engineer, decompile or disassemble all or any portion of the Service or the Content. 
  18. Remove, alter, conceal any copyright, trademark, patent or other proprietary rights notices contained in the Service and/or the Content.

8. Charges and Billing
You agree to pay all fees or charges incurred by Your Account, including applicable taxes, in accordance with these Terms of Use and the billing terms that are in effect at the time that the fee or charge becomes payable. Unless otherwise indicated, all prices are in US Dollars. You represent to Passport Booth that You are an authorized user or an authorized user of the chosen method of payment used to pay all fees You incur plus all applicable taxes. YOU ARE FULLY LIABLE FOR ALL CHARGES TO YOUR ACCOUNT.

9. Communications
By providing Your email address to Passport Booth and subscribing to Passport Booth communications, You understand You may receive periodic information regarding current and future services offered on the Service and/or related third party products. You may unsubscribe at any time by terminating Your Account as described in Section 12 (Termination and Survivability).

10. Privacy/Security
You understand and agree that any information provided by You or collected by Passport Booth in connection with Your use of the Service will be used in the manner described in these Terms of Use and in Passport Booth’s Privacy Policy passportbooth.com/terms, such privacy policy being incorporated into and made a part of these Terms of Use by this reference. If You do not agree to the Privacy Policy You may not use the Service. You are fully responsible for taking precautions and providing security measures best suited for Your situation and intended use of the Service.

11. Jurisdictional Issues and Export Control Laws
The Service is controlled and operated by Passport Booth from its offices within the United States. Passport Booth makes no representation that Content and other materials available through the Service are appropriate or available for use in any other locations. Those who choose to access the Service from other locations do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable. 

You agree to abide by applicable export control laws and not to transfer, by electronic transmission or otherwise, any Content or other materials subject to restrictions under such laws to a national destination prohibited by such laws, without first obtaining, and then complying with, any requisite government authorization. You further agree not to upload to the Service any data or software that cannot be exported without prior written government authorization, including, but not limited to, certain types of encryption software. 

The Content may not be re-exported, downloaded or otherwise exported into (or to a national or resident of) any country to which the U.S. has embargoed goods, or to anyone on the U.S. Treasury Department’s list of Specially Designated Nationals or the U.S. Commerce Department’s Table of Denial Orders. You represent and warrant that You are not located in, under the control of, or a national or resident of any country or on any such list.

12. Termination and Survivability
These Terms of Use are effective until terminated. Passport Booth may terminate these Terms of Use with or without notice to You by terminating Your Account as set forth in Section 3 (User Accounts). You may terminate these Terms of Use and Your Account by sending an email stating Your intention to terminate these Terms of Use to Passport Booth at: support@passportboorth.com, Attn: Accounts Department with the subject line “Account Termination”. Such termination will not be effective until acknowledged by Passport Booth but not more than twenty (20) business days after sending such termination email. 

The provisions of Sections 4 (Ownership of Content), 5 (User Limitations), 6 (Copyright Policy), 12 (Termination and Survivability), 14 (Disclaimer of Warranty; Limitation of Liability), 15 (Indemnity), 16 (Jurisdiction and Choice of Law), and 17 (Dispute Resolution and Arbitration) shall survive any termination of these Terms of Use.

13. Links to Third-Party Sites
The Service may link to third party sites (“Linked Sites”). These Linked Sites are not controlled by Passport Booth. Passport Booth is not responsible for the information of the Linked Sites, for the business practices or privacy policies of the Linked Sites, or for the collection, use or disclosure of any information by the Linked Sites. Passport Booth provides links to the Linked Sites only as a matter of convenience, and the inclusion of any link does not imply an endorsement by Passport Booth of any Linked Site. 

You acknowledge and agree that Passport Booth does not endorse, and shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such information, goods or services available on or through any Linked Sites. You agree that Your use of the Linked Sites, including without limitation Your use of any information, data, advertising, products, or other materials on or available through the Linked Sites, is at Your own risk and is subject to the term and conditions or use applicable to the Linked Sites. 

Passport Booth is not involved in any way in the actual transaction between the Linked Sites and You. Passport Booth acts solely as a passive conduit for the Linked Sites’ sales, distribution and the communication of Your information with regards to transaction with Linked Sites. 

You assume any and all risks, known or unknown, now existing or hereafter arising, related to the transactions with the Linked Sites’ items, including, but not limited to, completing transactions, default, negligence, unauthorized use of Your Account and password and other users acting under false identity. 

You acknowledge that Passport Booth is not a part to any possible future disputes between You and the Linked Sites. Resolution of any dispute is the full and sole responsibility of the involved parties and Passport Booth will not act as a mediator between them. You release Passport Booth, its agents, representatives and employees, from any and all claims, demands and damages, direct and indirect, suspected and unsuspected, arising from such dispute.

14. Disclaimer of Warranty; Limitation of Liability
“Passport Booth Parties” means Passport Booth and its affiliates, subsidiaries, officers, directors, stockholders, employees, licensors, distributors, sublicensees, agents or subcontractors). 

YOU EXPRESSLY AGREE THAT USE OF THE SERIVICE IS AT YOUR SOLE RISK AND NO WARRANTY OR GUARANTEE IS MADE AS TO THE APPROVABILITY OF THE PHOTOS TAKEN OR PURCHASED THROUGH THE SERVICE. 

THE SERVICE ISPROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS FOR YOUR USE, WITHOUT WARRANTIES (INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, ACCURACY, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND ANY WARRANTIES THAT MAY ARISE FROM COURSE OF DEALING, COURSE OF PERFORMANCE OR USAGE OF TRADE) OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, UNLESS SUCH WARRANTIES OR CONDITIONS ARE LEGALLY INCAPABLE OF EXCLUSION. 

THE DISCLAIMERS OF LIABILITY CONTAINED IN THIS SECTION APPLY TO ANY DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS, LOSS OF DATA, OR LOST PROFITS) OR INJURY CAUSE BY ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, THEFT OR DESTRUCTION OR UNAUTHORIZED ACCESS TO, ALTERATION OF, WHETHER FOR BREACH OF CONTRACT, TORTIOUS BEHAVIOR, NEGLIGENCE, OR UNDER ANY OTHER CAUSE OF ACTION. 

YOU ACKNOWLEDGE AND AGREE THAT YOUR EXCLUSIVE REMEDY FOR ANY DISPUTE WITH PASSPORT BOOTH IS TO STOP USING THE SERVICE, AND TO CANCEL YOUR ACCOUNT(S). IN NO CASE SHALL THE LIABILITY OF THE PASSPORT BOOTH PARTIES TO YOU EXCEED THE AMOUNT THAT YOU PAID TO PASSPORT BOOTH OR ITS DESIGNEES FOR THE APPLICABLE SERVICE GIVING RISE TO ANY SUCH LIABILITY. IN NO CASE SHALL THE PASSPORT BOOTH PARTIES BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE OR THE CONTENT, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICE, CONTENT, OR INTERACTIONS WITH PASSPORT BOOTH. 

BECAUSE SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR THE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, IN SUCH STATES OR JURISDICTIONS, THE LIABILITY OF PASSPORT BOOTH AND THE PASSPORT BOOTH PARTIES SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW. PASSPORT BOOTH DOES NOT ENDORSE, WARRANT OR GUARANTEE ANY THIRD-PARTY PRODUCT OR SERVICE OFFERED THROUGH THE SERVICE AND WILL NOT BE A PARTY TO OR IN ANY WAY BE RESPONSIBLE FOR MONITORING ANY TRANSACTION BETWEEN YOU AND THIRD-PARTY PROVIDERS OF PRODUCTS OR SERVICES.

15. Indemnity
You agree to defend, indemnify and hold harmless Passport Booth and its directors, officers, employees, agents, shareholders, licensors, parent companies and representatives, from and against all claims, losses, costs and expenses (including without limitation reasonable attorneys’ fees) arising out of (a) Your use of, or activities in connection with the Service; (b) any violation of these Terms of Use by You or through Your Account or using Your user name; or (c) any allegation that any information, messages, or materials that You make available or create through the Service infringe or otherwise violates the copyright, trademark, trade secret, privacy or other intellectual property or other rights of any third party.

16. Jurisdiction and Choice of Law
These Terms of Use, and any disputes arising from or relating to the conduct covered by the Terms of Use, are governed by the laws of the State of California. You hereby submit to the exclusive jurisdiction, including waiving any objection to personal jurisdiction, of the courts of Collier County, Florida without regards to any principles of conflicts of laws and the United Nations Convention on Contracts for the International Sale of Goods. Those who choose to access the Service from locations outside of Florida do so on their own initiative contrary to the terms of these Terms of Use, and are responsible for compliance with local laws if and to the extent local laws are applicable.

17. Assignment
Passport Booth may assign these Terms of Use, in whole or in part, at any time. You may not assign, transfer or sublicense these Terms of Use or any or all of Your rights or obligations under these Terms of Use without Passport Booth’s express prior written consent.

18. Waiver
No waiver by either party of any breach or default hereunder will be deemed to be a waiver of any preceding or subsequent breach or default.

19. Headings
Any heading, caption or section title contained herein is inserted only as a matter of convenience, and in no way defines or explains any section or provision hereof.

20. Notice
Notices to You may be made via posting to the Service, by email, or by regular mail at Passport Booth’s discretion. Passport Booth may also provide notices of changes to these Terms of Use or other matters by displaying such notices or by providing links to such notices on Passport Booth’s Service. 

21. Severability
If any part of these Terms of Use are determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of these Terms of Use shall continue in effect.

22. Complete Agreement
These Terms of Use, including the documents expressly incorporated by reference, constitute the entire agreement between You and Passport Booth with respect to its subject matter. These Terms of Use supersede all prior or contemporaneous communications, whether electronic, oral or written, between You and Passport Booth with respect to its subject matter and You represent that You have not relied on any such communications in accepting these Terms of Use.

24. Questions
Passport Booth’s performance of these Terms of Use are subject to existing laws and legal process, and nothing contained in these Terms of Use is in derogation of Passport Booth’s right to comply with governmental, court, and law enforcement requests or requirements relating to Your use of the Service or information provided to or gathered by Passport Booth with respect to such use. 

A printed version of these Terms of Use and of any notices given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms of Use to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. 

The parties agree that all correspondence relating to these Terms of Use, shall be written in the English language.
